TERMS AND CONDITIONS OF USE

CONTRACT FORMATION

Any order implies an acceptance without reserve of the present general conditions of sale notwithstanding any general conditions of purchase and annotations of the buyer.

All estimates are valid for 1 month. After this period ECD is no longer obliged to execute the order under the same conditions.

All orders will be accepted subject to the following three conditions:

- receipt by the customer of an order acknowledgement sent by ECD

- acceptance of payment terms

- full payment or payment of the deposit specified in the estimate.

PRICE

All our prices are exclusive of tax, from Colombes (92) or Le Havre (76)

These prices are subject to change during the year due to raw material costs and foreign currency fluctuations and do not constitute a commitment on our part.

DELIVERY TIMES

Online sales: After confirmation and validation of the order, ECD commits itself to deliver to its carrier, all the standard references not personalized ordered by the buyer and this within a maximum of 2 working days. According to the choice of the purchaser and according to the weight/volume of the ordered goods, the delivery is made by carrier or by Colissimo within 2 to 3 working days.

Classic sale: Our delivery times are indicative and without obligation. In any case, we could not undergo compensations of delay. A cancellation of order for delay would be accepted only after a delay of 3 weeks after formal notice to deliver by registered letter.
For printing jobs, the delivery time is calculated from the acceptance of the PROOF OF PRINT, without reservation.

Online sales of print jobs: the deadline is specified on the order acknowledgement. When technical information or variable data are necessary for the execution of the order by ECD, the customer undertakes to provide them within the time limit specified in the estimate. In case of non-respect of this delay, ECD will not be held responsible.
Payment

All invoices are payable within 30 days net for customers with an open account, subject to acceptance by our Credit Insurance. All new customers must pay either cash, or a deposit of 50%, the balance by check or by draft at 30 days. Any other arrangement must be agreed upon in advance by ECD.
The orders of printed and personalized articles give obligatorily place to the payment of a deposit stipulated in the estimate.
Any delay in payment will automatically lead to the invoicing of interest on arrears at the legal rate increased by three points, as well as the immediate payment of the outstanding amounts.

Online sales: The orders made and confirmed on the www.ecd.fr are payable are payable with the order by credit card in a secure environment VISA, MASTER CARD or PayPal. The order is validated only when the banking or financial institution has given its agreement. If it is refused, the order is purely and simply cancelled.

In case of delivery outside of metropolitan France, the customer agrees to pay all taxes due on the import of products, customs duty, value added tax, and any other taxes due under the laws of the country where the order is received.

Online sales: RIGHT OF CANCELLATION

The buyer has 7 days (as from the reception of the articles) to make an opinion. In case of request for exchange or refund, the new article(s) must be returned in its/their original packaging and accompanied by all the possible accessories, instructions for use and documentations to the following address:

In case of exercise of the right of withdrawal, ECD is bound to reimburse the sums paid by the customer, without expenses, except for the return costs. The refund is made within a maximum of 15 days.

CANCELLATION OF AN ORDER

No cancellation of order is accepted after delivery of the goods.

EXPEDITION AND DELIVERY

Our merchandises and furniture always travel at the risks and dangers of the recipient who will have to check the sending and will make the reserves of use near the conveyor, to confirm under 48 hours by LR with AR addressed to the conveyor, with copy to ECD.
The specified price excluding taxes on the www.ecd.fr do not incorporate the delivery fees. It will be added once the order is completed according to the formula chosen by the client.
If for available reasons an order is shipped in in several instalments to the customer he will only, pay for 1 delivery. If the client wishes 2 places of delivery, it places 2 orders, with the expenses of delivery relating to it

CONTRACTUAL WARRANTY

ECD warrants the equipment against design defects for a period of 1 year from the date of shipment of the equipment. The warranty will be cancelled in case of an abnormal use of the equipment or an accidents due to force majeure. Consumables and cutting tools are not covered by the warranty.

The warranty is strictly limited to the free replacement of the parts that the customer will have previously sent to ECD at his expenses and that will have been recognized as defective after analysis by ECD.

CLAIMS

In order to be valuable the claims should be addressed within an 8-day delay after receipt of the merchandizes by registered letter with acknowledgement of receipt.

In case of delay, damage, shortages or losses, the consignee is the only one competent to make claims to the carrier, which must be confirmed within 48 hours by registered letter with acknowledgment of receipt.

RETURN OF MERCHANDISE

- SPECIAL FABRICATIONS: no goods will be returned or exchanged.

- STANDARD ARTICLE: ECD may accept the return of goods subject to the following express conditions:

- the goods in question must be strictly standard to the exclusion of any goods specially made for the customer.
- The customer is responsible for the return shipping costs.
- the request for return must be motivated and formulated by the customer before the reshipment.
- after reception and acceptance of the returned goods by the customer, ECD sends to the latter a credit note of the value of the invoicing of the goods in question under deduction of a fixed price of 25 € excluding VAT for the return costs, excluding the transport costs.

PRINTING WORKS

A printing work order will be executed only after the signature of an “Good to Draw”. The models produced by ECD remain the property of ECD, even if they are the subject of an invoice.
ECD reserves the right to reproduce on its commercial documents the illustrations of products made by ECD for reference purposes, unless otherwise specified in writing.

CODE OF PRACTICE (MANUFACTURING TOLERANCES)

In the case of personalized or special cards, we can deliver and invoice pro rata up to 5% more or less than the quantity ordered without our customers being able to make any claims. The invoiced price will be proportional to the quantity delivered.

RETENTION OF TITLE

We reserve the property of the goods until full payment of the price (law 80-335 of 12-05-1980). The buyer takes the responsibility of the goods from the day of the delivery for theft or destruction.

DATA PROCESSING AND FREEDOM:

The personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. The lack of information leads to the non-validation of the order. In accordance with the " Data Processing and Liberties ", law the processing of personal information about customers has been declared to the national commission for data processing and freedoms (NCDPF). The customer has (article 34 of the law of January 6, 1978) a right of access, of modification, correction and suppression of the data which concern it, which it can exert near ECD.

ECD commits itself not to communicate, the coordinates of its customers to a third party.

ASSIGNMENT OF COMPETENCE

Only the Commercial Court of Nanterre is competent in case of litigation, notwithstanding the general conditions of purchase of the customer and this, even in case of appeal in guarantee or plurality of defenders, summary procedures or on request. Only the French law is applicable.
